It seems Washington capitulated because he never wrote a Doctrine of Conquest claiming all the spoils of war the patriots fought for.
Washington did nothing for about two years to formally end the war by dictating the terms to end the war. This conquest document would have documented that a victorious nation (America) in war acquired sovereignty over the conquered nation (British Crown) and could exert its own legal and political jurisdiction chosen by its sovereign residents.
The practice for creating a doctrine of conquest dates back at least to Roman law. Instead George Washington allowed King George III to dictate his own Trilateral Treaty for his own needs in 1783 Treaty of Peace.. Ben Franklin was lead negotiator for the King. In the First Article the king claimed his States to be Free and Sovereign. Not We the People as they remained as they were before the war – citizens subjects and debt slaves.
At this point the Colonist/Common Man was not allowed to vote, have land ownership with free and clear title (allodial or land patent), wasn’t allowed to implement their Rule of Law choice as Common Law built on the foundations of God’s Law/Natural laws that all 13 Colonies agreed to.

Then in 1791 Washington and Hamilton agreed with King George and the Tories to create the First Bank of America with all foreign Charter members. there were a few hiccups with this bank but it finally morphed into the Federal Reserve. Then later more NGOs were added like the IRS and SSA.
